The Association for Clinical Oncology (ASCO) joined more than 100 other health organizations in sending a letter to congressional leadership urging them to include the targeted and limited liability protections in the bipartisan “Coronavirus Provider Protection Act” (H.R. 7059) in the next COVID-19 relief package.
Due to the extraordinary nature of the Public Health Emergency (PHE), the bill is intended to protect physicians and other health care professionals where health care services are provided or withheld in situations that may be beyond their control due to COVID-19. The protections would extend to those who provide care during the COVID-19 PHE and for a reasonable time after the emergency declaration ends—but not in situations of gross negligence or willful misconduct.
