The Office of Inspector General (IG) for the Department of Health and Human Services released a preliminary report analyzing the impact of the first six months of the oncology demonstration project. The Centers for Medicare and Medicaid Services (CMS) set up the demonstration project in 2005 to look at the pain, nausea/vomiting, and fatigue of cancer patients undergoing chemotherapy. The IG report was in response to a request by Senator Charles E. Grassley (R-IA), the Chairman of the Senate Finance Committee. Senator Grassley also sent a letter yesterday to President Bush urging that the demonstration be "fixed."

ASCO is pleased to report that House Resolution 261, a resolution urging the Centers for Medicare & Medicaid Services (CMS) to extend the oncology demonstration project beyond 2005, was passed this afternoon by the House of Representatives by a voice vote.

Representative Nancy Johnson (R-CT), Chair of the House Ways & Means Subcommittee on Health and Representative Nathan Deal (R-GA), Chair of the House Energy & Commerce Subcommittee on Health have written a letter to Department of Health and Human Services Secretary Michael Leavitt requesting that supplies and pricing for intravenous immune globulin (IVIG) therapy be investigated by the Office of the Inspector General (OIG).

As we mentioned in the Medicare and Quality Care Update ASCO distributed earlier this week, the Centers for Medicare & Medicaid Services (CMS) has released the 2006 proposed physician fee schedule, along with a fact sheet highlighting some of the effects of the Oncology Demonstration Project and an update on the competitive acquisition program (CAP).

ASCO would like to take this opportunity to clarify the status of House Resolution 261 (H. Res. 261), which calls on CMS to extend the oncology demonstration project beyond 2005.Despite some reports, H. Res. 261 was not included in the energy bill that passed last night.

ASCO is pleased to report that today the House Energy and Commerce Committee has taken an important first step in moving House Resolution 261 to the floor of the House of Representatives. The action taken by the Committee - called "reporting out" the bill - occurs before the legislation moves to the full House of Representatives for a vote.

As we mentioned in last week's Medicare and Quality Care Update, ASCO has done a detailed summary of the interim final rule on the Competitive Acquisition Program (CAP) that was issued by the Centers for Medicare and Medicaid Quality (CMS) on June 27, 2005. ASCO will continue to work with CMS on many of the issues and questions raised by this rule.
